Authorized Agent / or Seller This is the service agreement for Equity Outpost, LLC, who is known as the operator of the website EquityOutpost.com, for real estate marketing and advertising services. This contract is between Equity Outpost, LLC, located at 8395 Keystone Crossing, Indianapolis, IN 46240, and the Authorized Agent / or Seller of the subject property(s) submitted online to the above site.
Terms & Conditions: Seller agrees to pay Equity Outpost, LLC the following fees for advertising and marketing services using the website www.EquityOutpost.com. The following one-time property set up fee and monthly marketing fees (3 month commitment) unless 12 month contracted membership payment package has been selected otherwise, are due at the time of member sign up and prior to your subject property being advertised live on the site. All charges to your credit card will depend on the selected package / membership you have chosen and will be applied once Equity Outpost has approved your property's submission.
Marketing / Advertising Fees: The initial payment, along with the signed contract and property information, must be received prior to being featured on the site. Equity Outpost, LLC will invoice and process the authorized agent's / seller's credit card every three (3) months for the monthly marketing fee (unless 12 month contracted membership payment package has been selected otherwise) on the following membership. Receipt of such payment will automatically renew the contract. Agent / Seller will remain under contract until a documented request to cease marking efforts or documentation of a successful closing is received by Equity Outpost, LLC. All marketing efforts will be terminated at the end of the current month in which the cancellation request is received; however, no pro-rations of fees will be credited back to seller/agent on any of the contracted membership programs. All marketing payments are due upon receipt. Any payments not received will result in your property being removed from the site.
Release of Liability: Equity Outpost, LLC, EquityOutpost.com, any subsidiary, or any officer or employee are hereby released from any harm, real or imagined, incurred by the client(s). Equity Outpost is acting solely as a real estate marketing firm and should not be considered, by any parties, as a REALTOR® or broker for the client. Equity Outpost will provide web advertising and real estate marketing services through www.equityoutpost.com and has not been retained as a listing agent or selling agent in any contractual capacity. This contract releases Equity Outpost and any subsidiaries from liabilities that include, but are not limited to the following: buyer / seller contract disputes; buyer / seller implied performance; buyer / seller promises; information accuracy; information typographical errors; lost marketing time; and technical problems involving hosting, site operations, or consumer's internet connection. Furthermore, the Authorized Agent / Seller releases Equity Outpost and any subsidiary from any cause resulting in a failure to close transaction as well as any REALTOR® or broker regulations.
Seller Provided Information Responsibility:
Authorized Agent / Seller acknowledge that he/she has a legal right to sell and market this property. The Authorized Agent / Seller assume all responsibility that the information pertaining to the subject property is accurate. Authorized Agent / Seller releases Equity Outpost, LLC, EquityOutpost.com, and any subsidiary from any responsibility or liability for information published on this site that is inaccurate or that could be construed as potentially misleading. It is also the Authorized Agent / Seller's responsibility to furnish any requested or required disclosures on the subject property should they be requested and follow State and Federal regulations when selling real estate to any interested buyers or interested parties. Furthermore, it is the Authorized Agent / Seller's responsibility to notify and obtain approval for any outside marketing efforts if he/she is currently entered into a listing contract with a broker.
Seller's Motivation & Discount:
The Authorized Agent / Seller agree to provide a truthful and accurate estimate of the competition's average asking price, discount, and motivation of the seller and the subject property. Agent / Seller assumes all responsibility of providing information to be advertised on the site as well as the price advertised on the subject property. Authorized Agent / Seller also assume responsibility for all information advertised regarding the property features and any information involving their listing.
REALTOR® / Agent Commissions: Should the Authorized Agent / Seller elect to account for REALTOR® commissions to be paid within their deal offering, it is their responsibility to calculate that expense within their advertised price. All commissions due to participating agents should be discussed directly with those parties and facilitated legally through the title company. EquityOutpost.com is not a broker cooperative site and is not involved with disclosing Buyer's Agent Commissions on transactions.
Equity Outpost Policy Regarding Leads At NO TIME are leads to be used by Equity Outpost or in any way shared with or sold to any third party for the benefit of any party other than the seller or listing agent of their properties being showcased. All leads shall be forwarded to the listing agent or seller and, although access to that information may be available, Equity Outpost may not use that information for purposes other than to benefit the authorized agent or seller for a specific property. (Benefits may include an email confirmation to interested parties that their contact request has been processed and follow-up with seller or listing agent to ensure contact requests are being received.)
By using this site you are agreeing that you have read and understand all the terms and conditions of this service agreement with Equity Outpost, LLC. If you are a Seller / Listing Agent you are representing that you have the legal right to sell and market any property(s) that has been uploaded under your username and you have knowingly entered into this service agreement for marketing and advertising services. Users / Marketing Members of this site agree to all terms and conditions set forth within this contract and any applicable State and Federal laws.
